GDPR – Information on the Processing of Personal Data

SPEL Manufacturing s.r.o., ID: 04638590, with its registered office at Třídvorská 1371, 280 02 Kolín V, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. 251268 C (hereinafter referred to as the “controller”), hereby informs the customer, if they are a natural person, as a data subject, that their personal data will be processed by the controller as follows:

1) For the purpose of fulfilling the controller’s legal obligations, the following personal data of the customer will be processed: name and surname or company name, residential or registered address, identification number, tax identification number, date of birth or personal identification number, scope and subject of performance, and other mandatory data under the relevant legislation. This personal data will be processed in particular to fulfil the obligations arising for the controller from the applicable legal regulations (e.g. in the field of accounting). Personal data may be transferred by the controller to third parties, especially state authorities, where the controller has a legal obligation to do so. Personal data will be processed for the period necessary to fulfil the legal obligations applicable to the controller.

2) For the purpose of fulfilling a contract to which the customer is a party, the following personal data of the customer will be processed: name and surname or company name, residential or registered address, delivery address, identification number, tax identification number, date of birth or personal identification number, e-mail address, telephone number, bank details, and other data provided by the customer for this purpose. This data will be processed in particular to handle the customer’s order and to exercise rights and obligations arising from the contract. Customers’ personal data may be transferred to the controller’s contractual partners, especially shipping companies for the purpose of delivering goods. The controller processes, for the duration of the contractual rights and obligations, the personal data necessary for fulfilling the contract, including related rights (e.g. warranty claims). Such data will also be processed for carrying out the necessary steps prior to entering into a contract at the customer’s request. The personal data will be processed for the purpose of negotiating the conclusion of a contract, and will be processed until the end of such negotiations.

3) For the purpose of the controller’s legitimate interests, the following personal data of the customer will be processed: name and surname or company name, residential or registered address, e-mail address, telephone number, identification number, tax identification number, date of birth or personal identification number, scope and subject of performance, and other data provided by the customer for this purpose. This personal data will be processed in particular for the purpose of enforcing any claims of the controller and for possible contact with a customer with whom a contract has been concluded, via offers of goods or services by the controller. Personal data will be processed for these purposes for the period necessary to exercise the legitimate interests of the controller. The controller informs the customer that if the customer is a legal entity, the controller will process the personal data of the natural person acting on behalf of the legal entity, to the extent of name and surname, job position, and possibly e-mail address and telephone number, for the reasons and scope described above. The controller informs the customer that their personal data may also be processed on behalf of the controller by a processor (a subject different from the controller, e.g. in connection with the provision of technical support, consultancy, property security, etc.). Upon request, the controller will inform the customer of the identity of the processors to whom the personal data has been transferred. The processing of obtained personal data of all customers is carried out in accordance with Act No. 101/2000 Coll., on the Protection of Personal Data, as amended (hereinafter the “Act”), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, effective from 25 May 2018 (hereinafter the “Regulation”). The customer has the right to request access to their personal data, i.e. to request confirmation whether their personal data are being processed and to request information about the processing. Furthermore, the customer has the right to data portability. The customer may request rectification if the personal data is inaccurate, or completion if the personal data is incomplete. The customer may object, request erasure, or restriction of processing only for reasons specified by law or the Regulation.

4) Conditions of personal data protection when shopping in the e-shop: The personal data specified is required to process orders and fulfil the contract if a purchase agreement is concluded between you and the seller. Such processing of personal data is permitted by Article 6(1)(b) of the Regulation – processing is necessary for the performance of a contract. The seller also processes this data for the purpose of record-keeping of the contract and any future exercise or defence of the rights and obligations of the contracting parties. Storage and processing of personal data is carried out for the above purpose for the period stipulated by law from the performance of the last part of the contract, unless another legal regulation requires retention for a longer period. Such processing is possible on the basis of Article 6(1)(c) and (f) of the Regulation – processing is necessary to comply with a legal obligation and for the purposes of the controller’s legitimate interests. The collection of cookies for the purpose described above may be considered personal data processing. Such processing is possible on the legal basis of the controller’s legitimate interest, as permitted by Article 6(1)(f) of the Regulation.

The customer has thus been informed of their rights arising from the Act and the Regulation, and has been informed which personal data, for what purposes, and for how long will be processed by the controller.
